1. Present revision has been filed by the assessee against the order of the Commercial Tax Tribunal, Gorakhpur dated 29.07.2009 passed in Second Appeal No. 83 of 2007 for A.Y. 2006-07 (penalty) under Section 10-A of the Central Sales Tax Act.
2. It has been stated at the bar that the aforesaid order of the Tribunal was later recalled by order dated 10.02.2010. Inasmuch as the impugned order stands recalled, the present revision does not survive.
3. The revision is dismissed as infructuous, leaving it open to the assessee to contest the matter, if the cause survives.
