Heard the learned counsel for the petitioner and the learned counsel for the respondent.
2. The petitioner, who is the wife of the 1st respondent, has filed the above Civil Revision Petition to withdraw the Original Petition in G.W.O.P.No.40 of 2013, pending on the file of the District Court, Chengalpattu and transfer the same to the file of the Family Court, Chennai.
3. Admittedly, the petitioner is a resident of Chennai and hence she sought for transfer of Original Petition to the Family Court, Chennai.
4. The Learned counsel appearing for the respondent submitted that the respondent has no objection for transferring the Original Petition to the file of the Family Court, Chennai. The learned counsel for the respondent further submitted that the respondent may be given liberty to file an appropriate application before the Family Court for dispensing with his personal appearance.
5. Having regard to the submissions made by the learned counsel on either side, Original Petition in G.W.O.P.No.40 of 2013, pending on the file of District Court, Chengalpattu is withdrawn and transferred to the file of the Family Court, Chennai. It is open to the respondent husband to file appropriate application before the Family Court, Chennai for dispensing with his personal appearance and in the event of such application being filed by the respondent, the Family Court, Chennai is directed to decide the same on merits and in accordance with law.
With these observations, the Tr.CMP petition is ordered. No costs.
