JUDGMENT / ORDER

Hydraulic Axle Vehicle which has been transported into the State was detained at the check post suspecting evasion insofar as the transfer of right to use the vehicle was suspected. The suspicion was raised on the ground that the letter, which accompanied the goods, stated that it is being transported for repair and maintenance. However, the service order showed that the same is to be used for a project work at BPCL, Ambalamughal. M/s.ABC India Ltd., seems to be a work contractor carrying on work contracts in BPCL, Ambalamughal for use of which the Hydraulic Axle Vehicle is transported. In the circumstances borne out from records, there shall be a direction to release the goods on executing simple bond without sureties and adjudication proceedings shall be WP(C).13581/14 2 continued and concluded within a period of two months from the date of release of the vehicle. Writ petition disposed of.
