JUDGMENT / ORDER

Harun-Ul-Rashid, J.
The interim order dated 20.6.2014 in W.P(C).No.15694/2014 is under challenge in this writ appeal. The appellants are the respondents in the writ petition. The petitioner in the writ petition, who was working as 'Melsanthi' in Kumarakom Sree Dharmasastha Temple, was placed under suspension pending enquiry. The allegation is that he left the temple on 31.5.2014 without giving any intimation to the temple authorities and he remained absent till 6.6.2014. He did not submit any application for casual leave. The appellants contended that the temple remained closed in the morning on 1.6.2014 and 2.6.2014 when a large number of devotees came to the temple and this resulted in mass protest of the devotees and public. In the said circumstances, it is said that the petitioner in the writ petition was placed under suspension.
2. The learned Single Judge vide the impugned order stayed the operation and implementation of Exts.P4 & P5 orders of suspension. There was a further direction to reinstate the petitioner in service as 'Melsanthi'.

3. It is submitted that the relief granted are the relief sought for in the writ petition. The learned Single Judge passed the order on the same day of moving the application for stay. It is submitted by the counsel for the appellants that the appellants have filed counter affidavit in the writ petition on 24.6.2014. The learned counsel for the respondent submits that reply affidavit will be filed within a period of three days. In such circumstances, we hope that the learned Single Judge will consider the matter on merits after affording an opportunity of being heard to both sides and pass appropriate orders and therefore, there is no necessity to entertain this writ appeal. The interim order staying the operation and implementation of Exts.P4 & P5 order of suspension shall be kept in abeyance till final order is passed in the interim relief sought for.
The writ appeal is disposed of as above.
