The Travancore Devaswom Board seeks in this petition sanction of this Court to execute the work of construction of Elamathil and Valiambalam with Balikkalpura in Kuttiyani Devaswom at 37% above the estimated cost of Rs.12,70,000/-.
2. It is stated in the petition that the estimate of the work has been prepared in accordance 2010 schedule of rates and since the said rates have already been revised, the rate quoted by the contractor is fair and reasonable.
3. This being a work relating to the construction of Valiambalam with Balikkalpura of the temple and since it is stated that the rate quoted by the contractor is fair and reasonable, we deem it appropriate to permit the Travancore Devaswom Board to execute the work as requested for, on the following terms:
(i) The work shall be awarded to the contractor within one month from today.
(ii) Before awarding the work to the contractor, the Board shall ensure that he is willing to execute the work at 37% above the estimated DBP No.151/2014 2 cost and that he will not claim any revision of rates during the continuance of the work.
(iii) If the contractor is willing to execute the work at the rate agreed upon by him and if the work is awarded to him on that basis, until the work is completed, periodical reports shall be filed by the Devaswom Officer concerned before the Honourable Ombudsman for the Travancore Devaswom Board, indicating the progress of the work.
