New Adarsha Youth Association, Nalgonda District and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT APPEAL No.1404 of 2009 Judgment: (per the Hon’ble Sri Justice Sanjay Kumar) This Writ Appeal is filed against the interim order dated 18.11.2009 passed in W.P.M.P.No.29320 of 2009 in W.P.No.22583 of 2009. By order dated 04.12.2009 passed in this appeal, the said interim order was suspended by a learned Division Bench of this Court. Though an application was filed in the Year 2013 by the respondents/writ petitioners to vacate the said order, it was not disposed of and still remains pending. We are therefore of the opinion that as the suspension granted in this appeal has been subsisting since December, 2009 and as the Writ Petition itself is yet to be heard on merits, no cause is made out for adjudication of the issues sought to be raised in this Writ Appeal. Such an exercise would render the Writ Petition infructuous.
We therefore close the Writ Appeal making the interim suspension dated 4.12.2009 absolute till the disposal of the writ petition. It shall be open to the learned counsel for the parties to make a mention before the appropriate Court for early hearing of the Writ Petition. We would request the learned Judge concerned to dispose of the matter expeditiously. There shall be no order as to costs.
Pending Miscellaneous Petitions shall stand dismissed in the light of the final order.
