HON’BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.13086 of 2014 ORDER:
The petitioner avers that he is the owner of Plot bearing No.44 admeasuring to an extent of 257.77 square yards in Survey No.759/A/A, in 78th Ward of Kurnool Municipal Corporation of Kallur Village and Mandal, Kurnool District. The petitioner avers that he purchased the said property on 10.03.2006. The petitioner intended to dispose of this property and when approached the Sub- Registrar, Kallur, Kurnool District (2nd respondent) to know the market value, the Sub-Registrar refused to furnish the market value informing the petitioner that it is treated as an assigned land and, therefore, no market value can be furnished.
2. Learned counsel for the petitioner circulated a xerox extract of a document which also discloses the description of the property as assigned land. However, the learned counsel for the petitioner submits that the property is not an assigned land, no notification is issued.
3. Having regard to the submissions made, without expressing any opinion on merits, the Writ Petition is disposed of directing the petitioner to submit a written representation to the Sub-Registrar, Kallur, Kurnool District (2nd respondent) as well as the Tahsildar, Kallur, Kallur Mandal, Kurnool District (3rd respondent) to ascertain the status and the basis for describing the land as assigned land. If there is any notification issued under Section 22- A of the Registration Act, 1908, the same shall be circulated to the petitioner. If the land is assigned, the particulars of the assignment shall be communicated to the petitioner to work out his remedies. Such communication/information shall be furnished to the petitioner within a period of two (2) weeks from the date of receipt of a representation from the petitioner. There shall be no order as to costs. Miscellaneous petitions, if any, pending in this writ petition, shall stand closed.
