JUDGMENT / ORDER

The petitioner has approached this Court with the following prayers:
“i) issue a writ of certiorari or other appropriate writ order or direction quashing the original of Exts.P3 and P4.
ii) issue a writ of mandamus directing or compelling the 1st respondent to assess the Cess under the Act after giving an opportunity to the petitioner for hearing and 2nd respondent to consider and pass orders on Ext.P5 representation and till such time to keep the revenue recovery proceedings initiated against the petitioner in abeyance.
iii) to grant such other relief which this Hon'ble Court may deem fit under these circumstances.”

When the matter came up for consideration before this Court, the learned Counsel for the petitioner submits that the petitioner does not intend to press the grievance raised in the writ petition any further and that the liability sought to be mulcted upon the shoulders of the petitioner may be permitted to be cleared by way of reasonable installments .

The learned Government Pleader points out that the W.P(C)No.28815 OF 2014 2 petitioner is liable to satisfy a sum of Rs.3,73,533/- with interest and collection charges, as borne by Exts.P3 and P4 notices issued under the Revenue Recovery Act. After considering the extent of liability to be cleared by the petitioner and also in view of the limited extent of relief sought for, the petitioner is permitted to liquidate the liability by way of 'six' equal monthly installments, the first of which shall be effected on or before 30.11.2014 , followed by similar installments to be effected on or before 30th of the succeeding months. Subject to the above, the recovery proceedings pursuant to Exts.P3 and P4 shall be kept in abeyance for the time being. It is made clear that, if any default is committed by the petitioner in remitting any of the installments, the respondents/Deputy Labour Officer and Special Deputy Tahsildar will be at liberty to proceed with coercive steps from the stage where it stands now, for realisation of the amount in a lump.
The writ petition is disposed of.
