Petitioner points out that his wife, who is the respondent herein, has instituted proceedings before the Family Court, Kattappana for dissolution of marriage as O.P. 133 of 2014. The petitioner has filed O.P.821 of 2014 before the Family Court, Mavelikkara for declaration. It is prayed that for a fair and just decision, O.P.821 of 2014 pending before the Family Court, Mavelikkara may be transferred to Family Court, Kattappana so that there may not be any inconvenience for the respondent in contesting the matter.

In the light of the fact that the move for transfer has come from the petitioner before the court below itself, i.e. for transfer O.P.821 of 2014 from Family Court, Mavelikkara to Family Court, Kattappana where as already pointed out by the petitioner, a matter instituted by the respondent is pending, Tr.P.(C).571/2014.
2 the respondent can have no grievance in ordering transfer.
In the result, this Original Petition is allowed and O.P. 821 of 2014 pending before the Family Court, Mavelikkara stands transferred to Family Court, Kattappana.
