Heard learned counsel for the petitioner and the learned Standing Counsel.
This petition has been preferred for the petitioner being provided and paid minimum in the pay scale in light of the decision of the Supreme Court in State of Punjab and Others Vs. Jagjit Singh [2017 (1) SCC 148].
From the authenticated copy of the counter affidavit which has been placed on the record, the Court notes that the respondents take the position that the petitioner was never appointed on the post of Guard in the college in question. It is further disclosed that one Kishan Lal was working on that post in the college. The respondents further refer to the records maintained by the college to state that the petitioner appears to have been engaged by the institution till 30 January 2018 and for which emoluments have been duly paid to him.
In view thereof no cause as such arises against the State respondents. This petition shall stand disposed of with liberty to the petitioner to initiate appropriate proceedings, if so chosen and advised, against the private respondent No.4.
