JUDGMENT / ORDER

In view of the submission canvassed at the bar on behalf of the learned advocate for the petitioner that the forum as well as Ombudsman did not have jurisdiction to enter upon the controversy raised and even pendency of the S.C.A. No.2505 of 2009, let there be proper examination. Hence, Rule. Direct service for respondent no.2 is permitted.
The Court is not inclined to grant any interim relief, as it would amounting to setting at naught the implemented order. However, the implementation of the order, it goes without saying, is the subject matter of this petition and otherwise also the petitioner is approached the Court within 30 days form today.
To be heard with S.C.A. No.2505 of 2009.
