JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) MONDAY, THE TWENTY NINETH DAY OF DECEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.39323 of 2014 BETWEEN The Toddy Tappers Cooperative Society, rep. by its President.
AND ... PETITIONER The State of Telangana, rep. by its Principal Secretary, Excise Department, Secretariat, Hyderabad and others.
...RESPONDENTS The Court made the following:
ORDER:
Petitioner–Society has questioned the show cause notice issued by respondent No.2, dated 29.11.2014, whereby he gave notice to the members of the Managing Committee of the petitioner-Society to show cause as to why action should not be initiated against them for the alleged violation of bye-laws under the A.P.Co-operative Societies Act. Petitioner has already submitted its explanation to the said notice on 16.12.2014.
2. Learned counsel for the petitioner states that though the petitioner has submitted explanation, the complaint allegedly given by respondent No.3 or the documents referred to in the impugned notice has not been furnished to the petitioner. However, they have given a detailed reply questioning the validity of the action taken by the Prohibition and Excise Superintendent.
3. I have heard learned counsel for the petitioner; learned Government Pleader for Excise appearing for respondent Nos.1 and 2; and Mr.T.Amarnath Goud, learned counsel appearing for respondent No.3.
4. I am, however, not inclined to entertain the writ petition as it is directed only against the show cause notice. Since the petitioner has already filed its reply, the Prohibition and Excise Superintendent would consider the said reply and hear the petitioner as well as respondent No.3 and take appropriate decision in the matter in accordance with law.
Writ petition is, accordingly, disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
