JUDGMENT / ORDER

This criminal original petition has been filed under Section 482 of Cr.P.C., praying to call for the records in S.T.C.No.144 of 2010 pending on file of the Judicial Magistrate No.II, Nagercoil and quash the same.
2.It is represented by the learned counsel for both sides that the respondent/defacto complainant passed away. The learned counsel for the petitioners also filed the copy of death certificate of the defacto complainant N.K.Ramaswamy. It is also submitted that the legal heirs of the defacto complainant have been arrayed as accused and they are the petitioners 1 and 2 herein.
3.The learned Judicial Magistrate No.II, Nagercoil took the private complaint on file for the offences under Sections 500 read with 34 of I.P.C. The learned counsel for the petitioners have also filed memo as to the death of the defacto complainant.
4.In view of the death of the defacto complainant and the fact that his legal heirs have already been arrayed as accused, S.T.C.No.144 of 2010 itself has become infructuous. Accordingly, this criminal original petition is disposed of. Consequently, connected miscellaneous petition is dismissed.
