Tmt.Jesu Mariyal vs Union Of India

Madras High Court|02 December, 2009

JUDGMENT / ORDER

Heard Mr.M.Suri, the learned counsel appearing for the petitioner and Mr.Pala Ramasamy, the learned Special Government Pleader appearing for the respondents.
2. This writ petition has been filed praying for a writ of Mandamus, to direct the 4th respondent to disburse the Educational loan amount to the petitioner to enable her daughter S.Saranya to continue her studies, within a specified period.
3. Though the prayer sought for by the petitioner, in the present writ petition, is for a larger relief, the learned counsel appearing on behalf of the petitioner had submitted that it would suffice, if the fourth respondent is directed to dispose of the representation, dated 19.11.2009, within a specified period.
4. The learned Special Government Pleader appearing on behalf of the respondents has no objection for this Court passing such an order.
5. In view of the submissions made by the learned counsels appearing on either side, the fourth respondent is directed to dispose of the representation, dated 19.11.2009, after giving an opportunity of hearing to the petitioner , as well as to the other parties concerned, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. The petitioner is directed to furnish a copy of the representation, dated 19.11.2009, to the fourth respondent, along with a copy of this order. However, it is made clear that this Court, by this order, has not expressed any opinion on the merits of the matter.
6. With the above directions, the writ petition stands disposed of. No costs.
