Tmt.G.Vasantha vs Thiru.Sukumar

Madras High Court|23 January, 2017

JUDGMENT / ORDER

The Civil Revision Petition is filed to direct the District Munsif, Omalur to dispose of the suit in O.S.No.29 of 2004 expeditiously in a time framed manner.
2. The said suit is filed for partition and permanent injunction. It is stated that the first petitioner is 78 years old and under treatment for various ailments and her health condition is deteriorating day-by-day. Earlier, in C.R.P.(PD).No.1234 of 2016, this Court, by order dated 02.06.2016, directed the District Munsif, Omalur to dispose of the said suit within six months from the date of receipt of the order. It is the grievance of the petitioners/defendants that when the suit is being posted for trial, the plaintiffs are filing I.As. one after another and are dragging on the matter. Hence, the petitioners have filed this revision for early disposal of the suit.
3. Considering the facts and circumstances of the case and the grievance of the petitioner, this Court directs the District Munsif, Omalur, to dispose of O.S.No.29 of 2004, on or before 31.07.2017. With this direction, the Civil Revision Petition is disposed of. No costs.
