JUDGMENT / ORDER

Petitioner is the accused in Crime No.521/14 of Viyyoor Police Station, Thrissur district. He is involved in offences punishable under Sections 377 and 506(1) IPC. The learned senior counsel for the petitioner submitted that the matter has been amicably settled between the de facto complainant and the accused. Annexures B and C are the affidavits filed by the 1st and the 2nd respondents herein, stating that the de facto complainant, under a mistaken notion had filed the case against the accused and he has no subsisting grievance against the petitioner. It is to be noted here that the de facto complainant is a person who is suffering from Cerebral Palsy. His mother has also sworn to an affidavit, which is marked as Annexure C, stating that the matter has been settled. The learned Crl.M.C.No.2277 of 2014 2 counsel appearing for the de facto complainant also submits that they have no grievance against the accused. Considering the nature of allegations and the fact that the parties have fully settled the matter, I find no reason to proceed with the prosecution against the accused. Therefore, the FIR in Crime No. 521/14 of Viyyoor Police Station is hereby quashed.
Crl.M.C. is allowed accordingly.
