JUDGMENT / ORDER

Heard learned counsel for the applicant, the learned Additional Government Advocate and perused the F.I.R. and other relevant papers filed in support of the bail application. As alleged, the accused applicant was arrested on the spot and some incriminating article along with cash was recovered from possession of the accused applicant. Learned counsel submits that the alleged recovery is fake and concocted and the allegations against the accused applicant are false and frivolous. It is further submitted that the offences so levelled against the acused applicant are triable by Magistrate. The applicant is in jail since 24.12.2009 and has no previous criminal history, as averred in para 2 of the application.
Considering the facts and circumstance of the case, I direct that the applicant be released on bail in case Crime No.682/2009 under sections 457/380/411 I.P.C. P.S. Alambagh District Lucknow on his filing a personal bond and two sureties each in the like amount to the satisfaction of the court concerned/remand Magistrate.
