The petitioner herein is the plaintiff in O.S.No. 103 of 2014 on the file of the Prl. Junior Civil Judge, Addanki. The trial Court, by its order dated 2.8.2014 in IA No. 2027 of 2014, granted ad-interim injunction till 10.9.2014, while dispensing with notice to the defendants. The defendants preferred CMA No. 1 of 2014 before the Sr. Civil Judge, Addanki who, by his order dated 10.9.2014 in IA No. 1206 of 2014, stayed the ad-interim injunction granted by the trial Court and directed the trial court to dispose of IA No. 2027 of 2014 within six months. The present revision petition is preferred by the plaintiff aggrieved by the first appellate court’s order staying the ad-interim injunction.
I have heard the learned counsel for the petitioner as well as the learned counsel for the respondents.
In my view, interest of justice would be appropriately served if the temporary injunction petition is heard and finally disposed of by the trial Court.
The revision petition is, therefore, disposed of directing the trial Court to hear both sides and decide IA No. 2027 of 2014 in O.S.No. 103 of 2014 expeditiously, preferably within two weeks from the date of receipt of a copy of this order. Learned counsel on either side assure the Court that their counterparts will cooperate with the trial Court in compliance of this order.
Miscellaneous applications, if any, shall stand closed. No order as to costs.
