Sri R.V. Pandey, who has accepted notices on behalf of respondent-Bank on the basis of instructions states that the hypotheticated property has already been auctioned on 26.02.2018 in pursuance to the impugned auction notice dated 21.01.2018 and sale deed of the property has also been executed in favour of the highest bidder Sri Sanjay Singh.
Learned counsel for the petitioners, at this stage, seeks leave of the Court to permit him to withdraw the writ petition to avail any other remedy as may be available to him under the law.
Prayer made is allowed.
The writ petition is dismissed as withdrawn with liberty to the petitioner to avail any other remedy, which may be available to him under the law and as may be advised.
