Heard Sri Ramesh Upadhyaya, learned counsel assisted by Sri Rajan Upadhyay, learned counsel for the petitioners, Sri Rohit Pandey, learned counsel for the respondent University and learned Standing Counsel for the State-respondents.
Learned counsel for the respondent University Sri Rohit Pandey raises a preliminary objection that the petitioners have an alternative remedy. He further submits that against the order dated 31.10.2018 passed by Vice Chancellor, Chhatrapati Sahu Ji Maharaj University, Kanpur, a reference lies to the Chancellor under Section 68 of the U.P. State Universities Act, 1973.
Sri Ramesh Upadhyaya, learned counsel assisted by Sri Rohit Upadhyay, learned counsel for the petitioners does not contest the aforesaid legal submission.
The petitioners have an efficacious and alternative remedy of approaching the Chancellor under Section 68 of the U.P. State Universities Act, 1973.
The writ petition is dismissed on the ground of existence of alternative remedy.
