JUDGMENT / ORDER

IN THE HIGH COURT OF JUDICATURE AT HYDERABAD FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) TUESDAY, THE TWENTY FIFTH DAY OF NOVEMBER TWO THOUSAND AND FOURTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.33579 of 2014 BETWEEN Tirumurthy Vignesh Kumar AND The Station House officer and others ... PETITIONER ...RESPONDENTS The Court made the following:
ORDER:
Heard.
2. The relief sought for in this writ petition is to direct the Station House Officer, Jaggaiahpet Police Station, Krishna District, to return the seized gold ornaments to the petitioner, which is subject matter of Crime No.101 of 2014. The said ornaments were initially seized, but however petitioner has submitted all the original documents pertaining to the seized property. In spite of that, since the station house officer did not return the seized gold ornaments, the present writ petition is filed.
3. Learned government pleader, on instructions, from the Sub-Inspector of Police, Jaggaiahpet Police Station, states that petitioner has subsequently produced the documents in support of the said ornaments and after examining them the seized articles were handed over to the petitioner on 13.11.2014 as per the proceedings of the Tahsildar, Jaggaiahpet Mandal, vide Rc.No.B.5/2014, dated 13.11.2014, and the petitioner has acknowledged the same. Copy of the acknowledgment where petitioner received 14 items of gold weighing 1151.395 gms is also enclosed. The instructions further say that in view of that, the case would be finalized and appropriate report would be submitted to the court.
4. Since the gold ornaments are already received by the petitioner, nothing further survives in this writ petition.
Writ petition is, accordingly, dismissed. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs.
