Heard Mr. Dinesh Kumar Sharma, Advocate, holding brief of Mr. R.K. Sharma learned counsel for applicant.
This application under section 482 Cr.P.C. has been filed for a direction to Judicial Magistrate, Hathras to conclude the trial of Complaint Case No. 1197 of 2020 (Tikatpal Vs. Chandrapal Singh) under sections 138 N.I. Act, Police Station- Hathras Junction, District Hathras, within time period fixed by this Court.
At the very outset, learned A.G.A. has raised a preliminary objection that since accused opposite party-2 has not yet appeared before Court below, no direction for time bound disposal of above mentioned complaint case can be issued.
When confronted with above, learned counsel for applicant could not overcome the same.
Application fails and is liable to be dismissed. It is accordingly dismissed.
