This is a petition filed under Section 24 of the Code of Civil Procedure seeking transfer of OP(Divorce) No.198/2014 pending before the Family Court, Kattappana to the Family Court, Pala to be heard along with proceedings instituted by the petitioner in the latter court. 2. Suffice to say that the marital relationship between the petitioner and the respondent became bitter and that gave rise to the litigations. Petitioner and the respondent have two children born in their wedlock. The petitioner had filed MC No.133/2013, OP No.612/2013 and OP(G&W)No.611/2013 before the Family Court, Pala. The respondent is alleged to have filed OP(Divorce) No.198/2014 before the Family Court, Kattappana. The petitioner points out that she is residing at Pala and she -2-
Tr.P.(C). No. 398 of 2014 finds it extremely difficult to go over to Kattappana to attend the posting of the case and she has nobody to accompany her. Her parents are advanced in age. She therefore, prays that OP(Divorce) No.198/2014 pending before the Family Court, Kattappana may be transferred to the Family Court, Pala for being tried along with petitions filed by the petitioner before that Court.
3. Even though notice was served on the respondent, there is no appearance on his behalf.
4. After having given anxious consideration to various aspects, it is felt that there is no reason as to why the prayer should be rejected.
The petition is allowed. OP(Divorce) No.198/2014 pending before the Family Court, Kattappana is transferred to the Family Court, Pala.
