The petitioner is the widow of one Shanmughan. This writ petition is filed challenging the rejection of the claim for pension under the Swatantrata Sainik Samman (S.S.S) Pension Scheme.
2. According to the petitioner, her late husband had remained underground for six months in connection with Punnapra Vayalar Struggle. The petitioner's husband was given Freedom Fighters' Pension by the State Government. However, the petitioner's case was not recommended by the State Government for obtaining pension under the S.S.S Pension scheme for the reason that the petitioner had not produced any credible evidence. The petitioner relied on the Personal Knowledge Certificate issued by Sri.H.K.Chakrapani. That certificate was for the period from 30.10.1946 to 17.07.1947. However, the petitioner had not claimed that her husband had W.P.(C) No.3848/2008 2 remained underground during that period. Merely because the petitioner is a recipient of Freedom Fighters' Pension itself cannot result in a claim for pension under the S.S.S Pension Scheme.
3. The Central Government, while considering the application, had adverted to the nature of the evidence produced. No primary evidence was made available. What was produced is the Personal Knowledge Certificate issued by Sri.H.K.Chakrapani. However, noting that the petitioner had not produced the Non- availability of Records certificate from the State Government, the Central Government rejected the secondary evidence produced.
In the above circumstances, I find no reason to interfere with the impugned order.
Accordingly, this writ petition is dismissed. No order as to costs.
