JUDGMENT / ORDER

1. Heard learned Counsel Mr. D.D. Vyas for the petitioner.
2. It is submitted that an affidavit is filed by the Registered Clerk who had gone to serve the respondent, but refused to accept the service.
3. On merit, it is submitted that the Suit is barred by provisions of Sections 50, 51 and 80 of the Bombay Public Trust Act.
4. Considering the above, ad-interim relief in terms of Paragraph 8.B) till further orders.
5. The matter be listed on 19th December, 2012.
