The petitioner approached this Court challenging Ext.P8 proceedings of the 2nd respondent-Tahsildar in effecting mutation of the property in Rs.No.271/2 of Peruvallur Amsom and Desom Thenhipalam Sub District in Malappuram District. Earlier, the party Respondents approached this Court by filing W.P.(C) No.23695/2012 seeking a direction to the official respondents to effect mutation in respect of the above property. The petitioner herein was the 4th respondent in that case. The writ petitioner herein raised a contention in W.P. (C) No.23695/2012 that there was a dispute regarding the property and the civil suits are pending. This Court held that transfer of registry will be subject to the result of the pending suits. The writ petitioner herein thereafter filed another writ petition-W.P.(C)No.30372/2013 suppressing th earlier direction of this Court. This Court dismissed that writ petition with cost W.P.(c).No. 32728 of 2014 : 2 :
of Rs.5,000/- to the Kerala High Court Mediation Centre. Based on the direction of this Court in W.P.(C) No.23695/2012, the Tahsildar effected mutation in favour of the party respondents as per Ext.P8. In Ext.P8 itself it was observed that mutation will be subject to the result of the pending civil suits.
2. In view of the above facts and circumstances, I do not find any merit in this writ petition. If the petitioner has any grievance on the merit of the decision of the 2nd respondent- Tahsildar, the petitioner has an alternate remedy before the Revenue Divisional Officer.
With the above liberty to the petitioner, the writ petition is dismissed in limine.
