The present Civil Application has been filed by the State for condonation of delay caused in filing the First Appeal on the grounds stated in the application inter alia that the time was consumed in communication with lawyer and getting necessary approval.
Heard learned counsel, Mr.R.V. Acharya for the applicant. Though served, none has remained present for the respondent.
In view of the guidelines laid down by catena of judicial pronouncements with regard to approach to be adopted in such matters, the present Civil Application deserves to be allowed.
The delay is condoned. The application stands disposed of as allowed. Rule is made absolute.
First Appeal is ordered to be placed for admission hearing on 13th February, 2012.
