Vishwamurthy, HCGP) This criminal petition is filed under Section 438 of Cr.P.C., praying to enlarge the petitioner on bail in the event of his arrest in Crime No.15/2017 of Tiptur Town Police Station, Tumakuru for the offence P/U/S 448, 323, 324, 354, 427, 504 and 506 r/w 34 of IPC.
This petition coming on for orders this day, the Court made the following:
ORDER Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent-State.
2. The petitioner (A2) apprehends arrest by the respondent police in their Crime No.15/2017 in respect of the offences punishable under Sections 448, 323, 324, 354, 427, 504 and 506 r/w Section 34 of IPC. During the pendency of this petition, Investigating Officer has filed chargesheet against two accused persons. This petitioner is arraigned as accused No.2 and his wife as accused No.1 in the chargesheet.
3. The case of the prosecution is, the first accused abused the complainant filthily and man handled her. The petitioner trespassed into the house of the complainant and caused injury on her both hands with axel blade and outraged her modesty, etc.
4. The first petitioner was arrested during the course of the investigation and now she is on bail. As could be seen from the chargesheet papers, the incident did not lead to serious injuries on the complainant.
In the light of the above circumstances, the petition is allowed. Petitioner is granted anticipatory bail in Crime No.15/2017 registered by the respondent- Police for a limited period of three weeks.
Within the above period, petitioner shall surrender before the concerned Court and move for regular bail.
Until disposal of the regular bail petition, this order will be in force.
In the event of his arrest by the respondent-Police within the above period, he shall be released on bail on his executing a self bond for a sum of Rs.1,00,000/-
(Rupees one lakh only) with one surety for the likesum to the satisfaction of the concerned Court.
