JUDGMENT / ORDER

Petitioner owns a building permit for constructing a residential building in Sy.No.105/5 of Keechery Village, Kanayannur Taluk. Petitioner wants to extract red earth from the site for constructing a residential building in the said property. 2. In view of the Government Order, petitioner does not require a permit for extracting excess red earth from the land. However, for the purpose of transporting, the petitioner requires P-form.
3. In view of the above, there shall be a direction to the 1st respondent to issue necessary P-form to the petitioner on the strength of Ext.P2 on being satisfied with the genuineness of the claim.
Needful shall be done within a period of ten days without insisting on an NOC regarding the same.

W.P.(C). No. 31646 of 2014 However, if the petitioner fails to construct any building pursuant Ext.P2, Geologist can take appropriate action against the petitioner, in accordance with law.
