JUDGMENT / ORDER

As against Ext.P1 assessment order passed by the 1st respondent, the petitioner submitted Ext.P2 appeal along with Ext.P3 petition for stay, which is pending consideration before the 2nd respondent. 2. In response to Ext.P4 show cause notice issued by the 1st respondent proposing to impose penalty, the petitioner has submitted Ext.P5 reply. In spite of the fact that petitioner has turned up before the 1st respondent seeking to explain the facts and figures, he was never entertained and this made the petitioner to approach this Court by filing the writ petition.
3. Heard the learned Government Pleader as well.
4. After hearing both the sides, the writ petition is disposed of directing the first respondent to consider and pass appropriate orders on Ext. P3 petition for stay, in accordance with law, as expeditiously as possible, at any rate, within 'one month' from the date of receipt of a copy of this judgment.
W.P.(C) No.34621 of 2014 2 Coercive proceedings, if any, shall be kept in abeyance till such time. With regard to the proposal for imposing penalty, Ext.P5 reply submitted by the petitioner in response to Ext.P4 shall be considered, after affording an opportunity of hearing to the petitioner. It shall be done within two months from the date of receipt of a copy of this judgment. The petitioner shall produce a copy of the judgment along with a copy of the writ petition before the concerned authority for further steps.
