ORDER:
Heard learned Counsel for the petitioners and learned Government Pleader appearing for the respondents.
This Writ Petition was filed challenging action of the respondents in not conducting elections to the fourth respondlent-Society pursuant to the proceedings of the first respondent No.1087/A4/05, dated 5.7.2007 and postponing the same without any basis.
In the counter affidavit filed on behalf of the second respondent, it is stated that in respect of admission of 162 members, some irregularities took place, but subsequently a communication was issued by the Assistant Director of Fisheries, Nellore to the learned Government Pleader in Rc.No.62-A-06, dated 12.07.2008 stating that all the members have paid the fixed share capital and entrance fee and handed over the receipts to the person-in-charge and hence the members are now became eligible to participate and contest in the elections. In view of the said communication, there is no impediment for conducting elections to the fourth respondent- Society pursuant to the proceedings of the first respondent dated 5.7.2007. In view thereof, the respondents are directed to conduct elections to the fourth respondent-Society forthwith and complete the same within a period of three months from the date of receipt of a copy of this order.
Subject to the above direction, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
