Thomas vs Station House Officer

High Court Of Kerala|04 December, 2014
|

JUDGMENT / ORDER

Petition filed under Section 439 Cr.P.C.
2. Petitioners are A1 and A2 in Crime No.402/2014 of the Kumbalakkad Police Station, registered for the offences punishable under Sections 341, 323, 324, 326 and 294(b) read with Section 34 of the Indian Penal Code.
3. The allegation against the petitioners is that on 30.09.2014 at 9.00 p.m., they came by a car and blocked the car of the defacto complainant on the road and they got out and abused the defacto complainant in filthy language and thereafter, they dragged out the defacto complainant from the car and attacked him with iron rod and wooden stick and inflicted grievous hurt thereby attempting to commit the murder of the defacto complainant. Petitioners have been in custody for the period from 04.11.2014 onwards.
4. Heard learned counsel for the petitioners and the learned Public Prosecutor.
5. It seems that the petitioners have criminal antecedents on their part. Investigation of this case is not over. The allegations against the petitioners are very grave and serious. A person was unnecessarily attacked on the road by blocking his car on the suspicion that it was he who had furnished information to the police regarding the illegal sand mining and transport of sand by the petitioners. Considering the seriousness of the allegations against the petitioners and the present stage of investigation, I am of the view that the petitioners are not entitled to be enlarged on bail.
In the result, this Bail Application is dismissed.
