JUDGMENT / ORDER

The petitioner has approached this Court with the following prayers :
i) Issue a writ of Certiorari or other appropriate writ, setting aside Exts. P11.
ii) Issue any other writ, order or directions as this Hon'ble Court declaring that the sub engineer in charge is not an assessing officer under section 126 of the Electricity Act, 2003.
iii) Issue any other writ, order or directions as this Hon'ble Court directing the 4th respondent to give electric connection to the petitioner's new house untrammeled by Exts. P11.
iv) Allow the costs of these proceedings.
2. The case of the petitioner is that exorbitant payment is ordered to be satisfied by the petitioner, pursuant to the inspection conducted at the premises of the petitioner and Ext. P8 mahazar prepared on 17.10.2014. On receipt of provisional order, the petitioner submitted statement of objections. But without considering the facts and figures, the proceedings were finalized as W.P.(C) No. 31236 of 2014 : 2 :
per Ext. P11 final order dated 31.10.2014, which made the petitioner to approach this Court by filing the present writ petition.
3. Today when the matter came up for consideration, the learned counsel for the respondent Board submits that the respondents are ready to have the matter reconsidered, giving an opportunity of hearing to the petitioner.
4. In the said circumstances, Ext. P11 will stand set aside and the 4th respondent is directed to reconsider the matter and pass final orders, also considering Ext. P10 statement of objections filed by the petitioner. This shall be done, after giving an opportunity of hearing to the petitioner, at the earliest, at any rate, within one month from the date of receipt of a copy of this judgment. Application, if any, pending before the 4th respondent for providing new connection shall be considered in accordance with the relevant provisions of law, as expeditiously as possible.
Petitioner shall produce a copy of this judgment along with a copy of the writ petition before the fourth respondent for further steps.
The Writ Petition is disposed of.
