Thomaiyar @ Chinnathambi vs The Superintendant Of Police

Madras High Court|14 November, 2017

JUDGMENT / ORDER

This petition is filed by the petitioner to issue a direction to the 2nd respondent not to harass the petitioner under the guise of enquiry citing his previous criminal records.
2. The petitioner admits that he was a notorious criminal earlier. After the marriage, except two criminal cases which was registered for the offences under Section 307 of IPC and extortion, no other case is pending against the petitioner. It is further stated that for the past four years the petitioner has not involved in any criminal offence and he is running his family by earning reasonable income out of legal means.
3. It is the grievance of the petitioner that citing the previous criminal records the petitioner is being harassed by the respondent Police and by asking him to come under their custody on several occasions. Since the petitioner wants to lead a peaceful life, he has also sent a representation to the first respondent, so that the police officials will stop harassing the petitioner.
4. As against the contention of the petitioner, the second respondent filed a counter affidavit pointing out the pendency of several cases against the petitioner from the year 2007. Except in three cases, where the petitioner paid fine other five cases are pending for investigation. It is also pointed out that History Sheet was also opened as against the petitioner in H.S.No.681 of 2015. It is stated that the activity of the petitioner is closely watched by the respondent Police to eradicate the crime. Apart from the criminal offences, it is also stated that the petitioner is creating nuisance within the jurisdiction of the second respondent Police.
5. Having regard to the facts given by the second respondent and the pendency of various criminal proceedings against the petitioner for serious offences, this Court is not inclined to entertain this petition. Accordingly, the Criminal Original Petition is dismissed as devoid of merits.
