[Order of the Court was made by A.SELVAM, J.] This writ petition has been filed under Article 226 of the Constitution of India praying to direct the first respondent to take immediate action to salvage fishing boats of Tamil Nadu fishermen seized by the Srilanka Government and hand over the same to respective owners on the basis of D.O. Letter dated 10.11.2016 sent by the Chief Secretary of Tamil Nadu to the first respondent, by way of issuing a writ of mandamus.
2.The learned counsel appearing for the petitioner has contended to the effect that for the purpose mentioned in the petition, the Chief Secretary of Tamil Nadu has already sent a D.O. Letter on 10.11.2016 and on that basis the Court can give necessary direction.
3.The learned Assistant Solicitor General of India appearing for the first respondent has also fairly conceded that the Chief Secretary of Tamil Nadu has sent a D.O. Letter on 10.11.2016 to the first respondent.
4.Considering the aforesaid factual circumstances, the first respondent viz., Secretary, Ministry of External Affairs, Government of India, New Delhi can be directed as indicated below.
5.In fine, this writ petition is allowed without costs and the first respondent is directed to take appropriate action on the basis of D.O. Letter dated 10.11.2016 within a period of two months.
