JUDGMENT / ORDER

This Court, by judgment dated 10.11.2014, disposed of the writ petition quashing Exts.P6 and P8 and directing the respondents to proceed with in accordance with law from the stage, at which Ext.P3 report was filed. It was further directed that final decision be taken within a period of three months from the date of receipt of a copy of that judgment. 2. The learned counsel for the review petitioner points out that since the appointment of the enquiry officer has to be made under Rule 198(2B) of the Co-operative Societies Rules by the disciplinary subcommittee, the disciplinary proceedings have to be commenced from the point of appointment of the disciplinary committee by the managing committee under Rule 198(2A) of the Rules. crept in the judgment is corrected, it would unnecessarily delay the proceedings. Since enquiry has to commence from that stage, the enquiry report also has to be annulled.
Therefore, the review petition is disposed of directing the respondents in the writ petition to proceed with, in accordance with law from the stage of appointment of the disciplinary committee under Rule 198(2A) of the Co-operative Societies Rules in place of the direction to proceed from the stage of Ext.P3 enquiry report. Ext.P3 enquiry report is annulled. The entire exercise shall be completed within a period of six months from today.
It is open to the disciplinary authority to decide as per law whether the respondent/writ petitioner be kept under suspension or not, till the proceedings are over.
