JUDGMENT / ORDER

Petitioner is a candidate who had written the examination for admission to professional degree courses for medicine in the year 2014. Her complaint is regarding the marks awarded. According to her, she is entitled to get a score of 399.2533 as against what has been awarded, ie. 394.1489. 2. A statement is filed on behalf of the 1st respondent inter alia stating that the issue involved is with reference to question No. 86, wherein the correct answer was option E, whereas in the answer sheet of the petitioner, answer at option D was also given a round mark, as a result of which the answer given to that question is treated to be wrong answer. It is in the said circumstances that the actual marks received by the petitioner is computed as 394.1489.

I have also perused the photostat copy of the original OMR sheet available with the respondent, which clearly indicates that the answer of question 86 at D option is also given a round mark, though it is not bubbled. Apparently, this is the reason for treating the answer as incorrect though the petitioner had bubbled the correct answer E as well. The candidate was expected to put the W.P(C) No. 13114 of 2014 -: 2 :-
bubbling only in one option. A round mark in another option has resulted in the candidate loosing the mark for that question. Since the computerized system of evaluation has adopted a method by which declaration of answers will be treated as wrong, I do not think that the petitioner is justified in claiming the mark for question No. 86.
In that view of the matter, there is no merit in the writ petition and the same is dismissed.
