The order refusing to remit the report and plan of the Advocate Commissioner in the final decree proceedings is impugned. The order is merely procedural and no case for interference invoking this supervisory jurisdiction has been made out.
2. I however permit the petitioner to examine the Advocate Commissioner at the time of trial in objection to his report and plan.
3. The Court below shall advert to the contentions after analysing the oral evidence adduced. The petitioner is also free to challenge the final decree in appeal in case he is aggrieved. The acceptance of the report and plan of the Advocate Commissioner can also be challenged in the appeal.
The Original Petition is disposed of.
