JUDGMENT / ORDER

Application filed under Section 438 of the Code of Criminal Procedure.
2. According to the petitioner, he is apprehending arrest in connection with Crime No.1068 of 2014 of Hosdurg Police Station registered for the offences punishable under Sections 174, 341, 324, 201, 202, 120(b) and 304(A) r/w Section 34 of the Indian Penal Code.
3. Learned Public Prosecutor has pointed out that investigation of this case is going on and presently, it cannot be said that whether an offence under Section 304 of the Indian Penal Code will be incorporated or not in the matter. As thinks stand now, the offences are bailable and therefore, an application for anticipatory bail is not maintainable.
4. In case any non-bailable offence is incorporated, the investigating officer shall give an opportunity to the petitioner to approach this court under Section 438 of Code of Criminal B.A.No.7806 of 2014 2 Procedure.
With the above observation, this bail application is dismissed.
