JUDGMENT / ORDER

Being aggrieved of the liability mulcted upon the shoulders of the petitioner under the Kerala Motor Vehicles Taxation Act in respect of the vehicle bearing No.KL.08R/6901, Ext.P2 appeal has been preferred before the second respondent/Deputy Transport Commissioner and Ext.P4 notice of hearing, which was scheduled to be held on 11.11.2014 was served on the petitioner. However, without any regard to the pendency of the above proceedings, coercive proceedings are being taken and pursued, as borne by Exts.P6 and P6(a), which made the petitioner to approach this Court by filing this writ petition.
2. Heard the learned Government Pleader as well.
3. Considering the facts and circumstances, there will be a direction to the second respondent/Deputy Transport Commissioner to pass final orders on Ext.P2 appeal, in accordance with law, after affording an opportunity of hearing to the petitioner, which shall be done at the earliest, at any rate, within six weeks from the date of receipt of a copy of the W.P.(C)No.30780 OF 2014 2 judgment . Coercive proceedings shall be kept in abeyance till such time. The petitioner shall produce a copy of the judgment along with a copy of the writ petition before the second respondent/Deputy Transport Commissioner for further steps..
The writ petition is disposed of.
