Petitioner submits that he is a holder of building permit for constructing residential building. Petitioner submits that he had approached the Geologist for issuance of P-form. The Geologist insists for production of work order for issuance of P-form. Petitioner on the strength of Ext.P1 building permit approached this Court for extracting ordinary earth from the site covered by building permit.
2. However, for the purpose of transporting ordinary earth, P-forms are necessary. Geologist cannot insist for production of work order for issuance of P-form.
3. In the light of the Government order, Geologist shall issue necessary P-from to the petitioner without insisting for production of work order. If the petitioner fails to construct any residential building, Geologist is free to take appropriate legal action against the petitioner for contravening the provisions of the Kerala Minor Mineral Concession Rules, 1967.
The Writ Petition is disposed of as above.
