Sri Birjesh Ojha learned counsel has put in appearance on behalf of respondent no.2.
Sole prayer made in the present writ petition is to issue a direction to respondent No.1 namely Judge, Small Causes Court, Varanasi to decide the Appeal No. 89 of 2011 (Thakur Radha Krishna Vs. Nagar Nigam) filed by the petitioner in a time bound manner.
To this prayer, learned counsel for the respondent raises no objection.
Be that as it may, without entering into the merits of the claim made by the petitioner, the present petition is disposed of with the direction to the respondent No.1 namely Judge, Small Causes Court, Varanasi to decide the Appeal No. 89 of 2011 (Thakur Radha Krishna Vs. Nagar Nigam), expeditiously, preferably within a period of four months from the date of submission of certified copy of this order.
