Heard learned counsel for the parties and perused the record.
Learned counsel for the petitioner, on being confronted with the order impugned to this petition, has requested that this Court may permit him to withdraw this petition with liberty to move the appellate authority which is an alternative remedy available to the petitioner.
Request being reasonable is being granted.
The appellate authority shall consider the case on merits along with stay application. This petition shall also form part of the appeal which may be filed by the petitioner.
With these observations, this petition is partly allowed.
