This First Appeal From Order is directed against the order dated 7.7.2010 passed in Original Suit No.191 of 1985 by which the earlier receiver has been removed and a new receiver has been appointed on a remuneration of Rs.7,000/- per month.
The submission of learned counsel for the appellants is that parties of the suit have suggested three names for the appointment of the receiver but ignoring the said names and without assigning any reason, the court below has appointed Ramkant Goswami as a receiver as he happens to be a relative of the Presiding Officer. A supplementary affidavit has been filed, wherein in paragraphs 4, 5 and 6 averments to the above effect have been clearly made.

Till the next date of listing the operation of the impugned order dated 7.7.2010 shall remain stayed.
