This Special Appeal is directed against an interim order dated 8 February 2018, which requires the petitioner-appellant to deposit 50% of the amount mentioned in the recovery notice.
The submission of the learned counsel for appellant is that the amount of the surcharge should be recovered only after conclusion of final enquiry.
The notice does not indicate that the amount is being recovered by way of surcharge.
In any view of the matter it is only by way of an interim order that 50% of the amount has been directed to be recovered. This issue can be raised by the petitioner at the time of hearing of the petition. There is, therefore, no need to interfere in the impugned order.
The Special Appeal is, accordingly, dismissed.
