1. The present application u/s.482 of the Code of Criminal Procedure has been preferred by the applicants herein – original accused to quash and set aside the proceedings of Criminal Complaint No.1210 of 2007 pending before learned Judicial Magistrate, First Class, Petlad.

Today when the present application is taken up for hearing, Mr.Y.M.Thakore, learned advocate appearing on behalf of the applicants has stated at the bar that the parties have settled the dispute amicably. However, due to non- availability of the original complainant before this Court, he is not in a position to produce settlement pursis. Under the circumstances, he seeks permission to withdraw the present application with a liberty to submit an appropriate application/pursis before the concerned Magistrate/Court pointing out that the parties have settled the dispute amicably. Therefore, he has requested to make suitable observation that as and when such application/pursis is submitted, the same be considered in accordance with law and on merits.
3. In view of the above, the present application is dismissed as withdrawn. As and when any application/pursis is submitted by the applicants before the concerned Magistrate/Court, the same be considered in accordance with law and on merits, if such application/pursis is maintainable. Rule is discharged. Ad-interim relief, if any, stands vacated forthwith.
