The petitioner is before this Court challenging the rejection of nomination, for reason of the petitioner having been issued with surcharge proceedings under Section 68 of the Co-operative Societies Act (Kerala), 1969. Such proceedings itself was challenged in W.P(C) No.6482/2010, which is said to be pending before this Court. The petitioner's nomination was directed to be accepted by an interim order and the petitioner is said to have been elected and the Managing Committee's term is also said to be expiring next year. In such circumstance, nothing survives in the writ petition. However, the contentions of the petitioner with respect to Section 68 proceedings shall be left open to be agitated in the other writ petition. Writ petition is closed.
