1. The petitioners have prayed for the following reliefs:-
"(A) This Hon'ble Court may be pleased to issue a writ of mandamus and/or any other appropriate writ, order or direction and may be pleased to call for record and proceeding of the election proceeding of the Deputy Sarpanch held on 18.01.2012 in the office of the group gram panchayat Lilvadeva and after pursing the record and proceedings, this Hon'ble Court may be pleased to quash and set aside the election of the Deputy Sarpanch held on 18.01.2012 and direct the respondent No.3 election officer to initiate fair process of election by appointing independent election officer and to conduct the election for the post of the Deputy Sarpanch afresh in accordance with law and thereafter elected candidate may be declared as the Deputy Sarpanch of group gram panchayat Lilvadeva.
(B) Pending, admission and final hearing of this petition, this Hon'ble Court may be pleased to restrain the respondent No.6 i.e. Vanrajbhai Govindbhai Labana and his agents, servants etc. from working as the Deputy Sarpanch of group gram panchayat Lilvadeva;
(C) That any other appropriate order, directions that may be deemed fit and proper be issued in the facts and circumstances of this case."
2. The averments made in the petition indicate that the issue involved is pending before the competent authority i.e. District Development Officer, Dahod since 20.01.2012.
3. In view of the above, it would be open for the petitioners to file an appropriate application for expedite hearing within a period of one week and the District Development Officer, Dahod shall decide the said application within a week thereafter and take appropriate decision for expediting the proceedings pending before it.
4. With the above observation, the petition is not pressed at this stage. The petition stands disposed of accordingly. No order as to costs. Direct service is permitted.
