Heard learned counsel for the parties.
Petitioner, a Sub-Inspector in 32nd Bn. P.A.C., Lucknow, by the impugned order dated 26 August 2019, passed by the fourth respondent-Superintendent of Police, U.P., P.A.C. Police Headquarters, Lucknow, has been transferred to P.A.C. Headquarters, Lucknow, in violation of transfer policy.
Learned Standing Counsel submits that the transfer is an exigency of service and the policy is merely a guideline and not a statutory provision. Petitioner a member of the Disciplined Force can be transferred in exigency of service.
In view thereof, the petition is dismissed as withdrawn with liberty to the petitioner to make an appropriate application before the competent authority. In the event of such an application is made before the fourth respondent, the same shall be considered and decided by reasoned and speaking order, expeditiously, preferably within a period of six weeks from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that this Court has not considered the claim of the petitioner on merit.
