Applicant who is original petitioner urges this Court that he was under the notice that the matter was fixed for hearing on 30th March, 2012. However, the same was in fact placed on board on 29.3.2012 and on the stipulated date, on account of his absence, the matter was dismissed for want of prosecution. With a request to restore the same, this Misc. Civil application has been filed. Considering the substantive cause as also genuineness of the explanation given, request for restoration is allowed.
Special Civil Application No. 2619 of 2012 is restored to file and the same is fixed for hearing on 2nd May, 2012.
Misc.Civil Application No.1117 of 2012 stands disposed of accordingly.
